William L. Poindexter 2L marked time yesterday as a quick juggling of judges delayed action on his $5 tangle with William L. Prosser, professor of Law.
Massachusetts District Court Judge Frederic A. Crafts has consented to sit in the case, after Franklin T. Hammond '92 disqualified himself because he had discussed the action with Professor Prosser. The preliminary hearing is set for Monday at 8 o'clock at the Langdell Hall courtroom.
Poindexter, whose $5 was allegedly misappropriated by his instructor on February 13, states, in his declaration, that he "has been damaged to the extent of the five dollars and five dollars additional for great mental anguish, suffering, and embarrassment."
The plaintiff has garnered an imposing legal staff of six law students and two practicing lawyers. The defendant is expected to handle his own case which will be judged in the law School's own "Commonwealth of Ames" before a Graduate jury.
