POSTPONEMENT SOUGHT IN FOSTER ASSAULT CASE

CASE WILL REST UNTIL NOVEMBER TWENTY-FIRST

Police will seek a postponement of the inquiry into the assault made upon Frank Foster, Dunster House janitor, which is scheduled to open in the East Cambridge Court tomorrow.

Though Foster is leaving the hospital today, his doctors petitioned Lieutenant Joseph Shannon to seek a week's postponement of the case as the janitor is still too weak to bear the strain of appearing in court.

Their indentity still remaining a police secret, the nine students who will serve as witnesses at the trial will not be summoned until next week as police feel sure postponement will be granted by Judge Robert Walcott.

Chief of Police, John J. Canney will continue his questioning of all those who attended the cocktail party in Dunster House in hopes of bringing to light some new evidence.

Thus the case will stand, if postponement is granted, until November 21, when Bennett Y. Ryan '37 and Eugene H. George '39, both released on ball, will appear in the third district court to face charges.
